There was never an article, treaty or agreement made and signed that says NATO expansion isn't allowed or wouldn't happen and even Gorbachev confirmed it, so NATO isn't doing anything illegal unlike Russia who signed the NATO-Russia Founding Act where it pledged to uphold "respect for sovereignty, independence and territorial integrity of all states and their inherent right to choose the means to ensure their own security".
