thats a good question, though to answer it you first have to understand that the entire conception of an "LGBTQ" community is something that came out of the Stonewall uprising (and later the development of the "queer movement" as a response) and is a particularly western concept; East Asians have different notions when it comes to gender and sexuality and to fully understand them you have to go back to the end of Korea's Joseon period to see how traditional Korean values began to be influenced by Japanese colonialism and the effect this had on the Korean family structure.
to answer your question a bit more directly, Koreans in the North don't really have laws that pertain to things like sodomy and same-sex marriage (its not at all illegal but those "rights" so to speak are not immortalized in any legal documents afaik. discrimination based on any racial, gender, or sexual preference is however, forbidden); basically if Koreans in the North want same-sex partners its perfectly fine but its also pretty uncommon to see, mostly because its just not as common in the culture as it is in other places in the world.
the beauty of the DPRK constitution is that it guarantees equal rights to all citizens with no caveats, something the USA still refuses to do to this day.

did you know that most defectors often choose to go back, except they cant, because the South Korean government wont let them? did you know that defectors are often payed up to $900,000 for testimonies and are payed more based on whether a story is "bankable" or not? did you also know that one of the most high profile defectors defected because he was facing a life sentence for raping and murdering a child?
